Acceptable Use and Usage Limits

This policy describes acceptable use of the Patcherly service (a brand of Shambix) and the usage limits that apply to your plan. By using the Service, you agree to comply with this policy. Violation may result in warning, throttling, suspension, or termination of your account.

1. Usage limits

Your use of the Service is subject to the limits of your chosen plan. These may include (but are not limited to):

  • Monthly fix limit: Maximum number of automated fixes or analyses per month (limits vary by plan; see your dashboard and the pricing page).
  • Max targets: Maximum number of websites or applications you can connect and monitor.
  • Max users: Maximum number of users per account.
  • Rate and volume limits: We may limit how many requests you can make and the size of request payloads to ensure fair use and service stability.
  • Analysis and context limits: Limits may apply to analysis duration, context size, and how much code or log context is used for AI analysis to prevent abuse and ensure quality of service.

Bring your own keys (BYOK): Some plans describe automated fixes or related features as “unlimited” when you use your own AI provider keys. That refers to not counting those actions against the plan’s monthly fix quota in the usual way; it does not permit abuse of the Service or a waiver of technical safeguards. Rate limits, analysis limits, and the other protections above still apply, and we may throttle or restrict traffic to prevent abuse and keep the Service stable for all users.

Current plan limits are shown in the dashboard and on the pricing page. If you exceed your plan limits, we may throttle your use, block further usage until the next cycle, or ask you to upgrade. We may introduce add-on or overage options in the future.

2. Fair use

You must use the Service in a reasonable manner consistent with its intended purpose. You may not:

  • Circumvent or attempt to circumvent usage limits, rate limits, or technical restrictions.
  • Use automated means (e.g. bots, scripts) to generate excessive traffic beyond normal use of the Service or dashboard, unless explicitly allowed by us.
  • Use the Service in a way that negatively affects the availability or performance of the Service for others.

3. Acceptable use

You may use the Service only for lawful purposes and in accordance with our Terms of Service. You must not:

  • Use the Service for any illegal purpose or in violation of any applicable law.
  • Use the Service to probe, attack, or attempt to gain unauthorized access to our systems, other customers’ systems, or any third-party systems.
  • Use the Service to host, distribute, or promote malware, phishing, or other harmful content.
  • Scrape, crawl, or harvest data from the Service, or use automated means to extract data from the Service, without our express written consent.
  • Use the Service for cryptocurrency mining, or any other use that imposes a disproportionate or abusive load on our infrastructure to evade payment or harm the Service for others.
  • Use the Service to send unsolicited bulk communications (e.g. spam, chain letters, unsolicited bulk email or messages), or to advertise in a way that violates applicable anti-spam or marketing laws.
  • Impersonate any user or entity, or misrepresent your affiliation or identity.
  • Resell or sublicense the Service to third parties without a separate agreement with us.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service (except as permitted by applicable law).
  • Submit to the Service any sensitive personal data (e.g. health data) or payment card numbers in error logs, uploads, or other Service Data - payments are processed by Stripe; do not place card data in monitored logs or non-billing fields. Exceptions apply only as described in our Privacy Policy and Data Processing Agreement.
  • Use the Service for high-risk applications (e.g. life-support systems, nuclear facilities, aviation control) without prior written agreement with us.

4. Enforcement

We may monitor use of the Service to ensure compliance with this policy and our Terms. If we believe you have violated this policy, we may:

  • Issue a warning and ask you to correct the behaviour.
  • Throttle, rate-limit, or temporarily suspend your access (including connector traffic).
  • Terminate your account and subscription.

These measures help protect platform stability, security, and fair use. We may apply them when behaviour threatens service quality for other customers or attempts to bypass safeguards - whether through the dashboard, connectors, or connector software (including modified or unofficial builds).

Fees and refunds when we enforce this policy. General rules for refunds, trials, cancellation, downgrades, and third-party purchases are in section 3 of our Terms of Service (especially 3.4 and 3.5). If we suspend or terminate your account or subscription because you violated this policy or the Terms (including serious or repeated abuse), we are not obliged to refund prepaid fees for the remainder of your current billing period or any unused part of your plan - subject always to mandatory rights under applicable law (for example in the EU or other jurisdictions). This approach is standard where access ends for breach: you are not entitled to keep using a paid service after material misuse at our expense.

Legal and regulatory action. Nothing in this policy limits our right to investigate suspected abuse, preserve records and logs as required for security and compliance, cooperate with law enforcement or regulators where we are legally permitted or required to do so, and pursue legal remedies (including injunctive relief or damages) where permitted by law - for example in cases of fraud, attacks on our systems, or other unlawful conduct.

5. Connector software, modifications, and support

We publish connector client software under the licenses stated with each package: a proprietary limited-use license for the Python, Node.js, and PHP agents, and GNU GPLv2 or later for the WordPress plugin. Official IDE / MCP plugin packages are licensed as stated with each package (currently Apache License, Version 2.0). Those licenses do not waive this policy or our Terms of Service. Patcherly is a registered trademark, property of Shambix.

Official support (helpdesk assistance, documented behaviour, and compatibility assurances) applies only to unmodified connector software obtained from our official sources as described in our documentation. Modified, forked, or third-party connector builds are not covered by official support and are used at your own risk.

Use of modified or unofficial connector software with the Service remains subject to usage limits, rate limits, and fair use. We may throttle, suspend, or terminate accounts where traffic or behaviour - including via modified connectors - circumvents limits, abuses resources, undermines security or billing controls, or degrades the Service for others.

6. Changes

We may update usage limits or this Acceptable Use policy from time to time. We will post the updated policy on this page and update the “Last updated” date. Material changes may be communicated via email or through the Service. Continued use after the change constitutes acceptance.
